For this, the rules related to forming political parties are mentioned in the People’s Representation Act 1951 in the Constitution.
According to these rules, to form a political party, one has to fill the form issued by the Election Commission. It has to be filled online. After which its printout has to be taken and sent to the Election Commission within 30 days along with other important documents. In this process, Rs 10,000 has to be deposited as fee.
Conditions for forming a party
According to the information, before starting the registration of the party, it is necessary to prepare its constitution. In which it is written that what will be the name of the political party, what will be its working method, how will the president of the party be elected? Along with this, information about people holding important positions in the party has to be given.
At the same time, the signatures of all those members must also be mandatory on the copy of the party constitution. The details of the party’s bank account also have to be given in the documents. The candidates themselves decide what the name of the party will be. But the Election Commission decides whether that name is valid or not. During this, the Election Commission checks whether the name is already registered. If a name is already registered then the party cannot be registered again on that name. For this the name has to be changed.
Apart from this, to establish a political party, it is necessary to have at least 500 members associated with it. Not only this, those members should not be associated with any other party. For this, an affidavit also has to be given, which confirms that the member is not associated with any other political party.

After examining all the documents related to party registration, the Election Commission gives the symbol to the party. Let us tell you that under The Election Symbols (Reservation and Allotment) Order, 1968, the Election Commission issues symbols to the parties. But there are some special rules for this also. For example, more than 100 election symbols remain in reserve with the Election Commission, which have not been allotted to any party till now.
Whenever it comes to issuing election symbols, the Commission issues one of the symbols for the party. However, any party can appeal for issuing a particular election symbol. After this the Election Commission looks into it. If that election symbol has not been allotted to any party then it can be issued. However, even after appeal, symbols of animals, birds and animals are not released.
